Welcome to workscounsel.com (the "Site"), operated by 305 LLC d/b/a WorksCounsel Consulting ("we," "us," or "our"). By accessing or using our Site, you agree to be bound by these Terms and Conditions ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Site.

2. Nature of Services

WorksCounsel Consulting provides human resources, communications, business strategy, and administrative consulting services. We use third-party platforms, including Cal.com for scheduling and FillOut.com for intake and inquiries, to facilitate our services.

3. Intellectual Property

All content published and made available on our Site—including but not limited to text, logos, graphics, documents, and frameworks—is the property of 305 LLC d/b/a WorksCounsel Consulting and its creators. You may not reproduce, distribute, or create derivative works from our content without our express written consent.

4. User Conduct

  • Use the Site for any illegal purposes.
  • Submit false, inaccurate, or misleading information through our intake forms (FillOut.com), email address connect@workscounsel.com, or scheduling links (Cal.com).

To the maximum extent permitted by applicable law, 305 LLC d/b/a WorksCounsel Consulting and its directors, officers, agents, employees, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Site or your reliance on any information provided on the Site.

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.

8. California Consumer Rights Notice

It does not constitute professional human resources, financial, or legal advice and should not be relied upon as a substitute for consultation with a qualified professional familiar with your specific business facts and circumstances.

2. No Professional or Attorney-Client Relationship

Your use of this Site, including submitting inquiry forms via FillOut.com, booking exploratory consultations via Cal.com, or sending emails to WorksCounsel Consulting, does not create a consulting or professional-client relationship. A formal consulting relationship with WorksCounsel Consulting is only established after a written consulting agreement has been signed by both parties.

3. Specific Licensure and Scope of Practice

Amy Klose is admitted to practice law exclusively by the Florida Bar. She is not licensed to practice law in the State of California. The HR consulting services provided by Amy Klose and WorksCounsel Consulting while operating within California are strictly limited to human resources, business strategy, and administrative consulting. These services do not constitute legal representation or legal advice, and no attorney-client relationship is formed or implied through any HR consulting engagement or use of this website.

4. Not a Law Firm

Despite the use of the word "Counsel" in the business name, 305 LLC d/b/a WorksCounsel Consulting is an HR and business consulting firm, not a law firm. We do not provide legal interpretations, draft legal documents for litigation, or offer legal counsel. If your business requires legal advice, you should seek the services of an attorney licensed to practice in your jurisdiction.

5. No Guarantees

WorksCounsel Consulting makes no guarantees regarding the results or outcomes of implementing any strategies or recommendations discussed on this Site. Every business is unique, and prior results or generalized frameworks do not guarantee a similar outcome for your organization.

Part 3: Privacy Policy

305 LLC d/b/a WorksCounsel Consulting ("we," "our," or "us") respects your privacy and is committed to protecting the personal information you share with us through our website, workscounsel.com (the "Site"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information. This policy is specifically designed to comply with the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and the California Online Privacy Protection Act (CalOPPA).

  • Directly from you: For example, from forms you complete or consultations you schedule via FillOut.com or Cal.com.
  • Indirectly from you: For example, from observing your actions on our Site via standard analytics.

3. How We Use Your Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason you provided the information (e.g., assessing your HR consulting needs).
  • To provide, support, personalize, and develop our Site, products, and services.

We do not sell your personal information. Furthermore, we do not "share" your personal information for cross-context behavioral advertising as defined by the CPRA. In the preceding twelve (12) months, WorksCounsel Consulting has not sold or shared personal information.

6. Your California Privacy Rights (CCPA / CPRA)

If you are a California resident, you possess the following rights regarding your personal information:

  • Right to Know and Access: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months.
  • Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.
  • Right to Correct: You have the right to request that we correct inaccurate personal information that we maintain about you.
  • Right to Limit Use of Sensitive Personal Information: We do not generally collect sensitive personal information, but you have the right to limit its use if we do.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.

8. "Do Not Track" Signals (CalOPPA)

We do not currently respond to "Do Not Track" (DNT) browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

9. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Once the data is no longer necessary for the purposes for which it was collected, it will be securely deleted or anonymized.
